Mighty Conversations Pty Ltd (referred to as “our”, “us” and “we”) supports individuals and organisations across a range of coaching and consulting services. 

Trust is at the core of our relationships with our coaching counterparts and our clients, and we recognise the importance of data privacy in establishing and maintaining this trust.

We are therefore committed to respecting and protecting the confidentiality and privacy of all individuals with whom we interact; and being transparent in our handling and processing of their personal information at all times. ​

This Privacy Policy explains in detail the types of Personal Information we may collect about you when you interact with us and how we use it. 

Personal Information 

Personal Information (also called Personal Data) is information that identifies, or can reasonably be linked directly or indirectly to, an identifiable person. Personal information does not include information that is anonymous, de-identified, or aggregated, as those terms may be defined under applicable law.

Personal Information we may collect from you

We may collect Personal Information directly from you when you use our website and / or services, such as:

  • if you contact us directly (e.g. phone call, website enquiry form or email);

  • if you ask to receive information about us or our services;

  • when you receive coaching or consulting services from us; 

  • if you participate in any client feedback surveys.

 

The types of information we collect from you may include:

  • personal identifiers, such as names, phone numbers or email / physical addresses.

  • professional information, such as your current employer, occupation, professional qualifications, work history and other information relating to your work and your relationship with it.

  • the services you have purchased, used or expressed interest in.

  • financial information, such as bank account information used to pay for services received from us.

  • records of our interactions, information contained in your correspondence with us, and preferences, such as frequency at which you wish to receive communications.

Personal Information we collect from others

Other than Personal Information you provide, we may receive additional information from other parties.

 

This has four primary sources, namely:

  • your employer where they have engaged us to provide you with coaching services or where they have engaged us to provide consulting services; and

  • existing clients or contacts who may provide us with contact information for the purpose of a referrals; and

  • where you have made information about yourself public online, such as on LinkedIn, other social media or your employers’ website; and

  • technology providers who support our website and other services. 

 

The collection and provision to us of information about you by your employer is likely to be governed by your employment contract, your employer’s privacy policy and / or applicable laws and regulations. Before we process any such information, we ask your employer to confirm that they have your consent to share your information to use for the purposes provided. If you have any concerns in relation to this, please contact your employer. 

We collect limited information about you from technology suppliers when you use our website. This information is provided in aggregated form to help us understand overall user interactions with our website, such as the location of visitors and time spent on each page, and it does not identify you. 

Our website uses cookies (small text files stored by your web browser when you use websites) and related technologies, such as pixels, local storage and beacons (collectively Cookies), to collect and store information when you use it. To learn more, see our Cookie Notice.

 

How we use this Personal Information

We will not use your Personal Information without having a lawful basis to do so. In most cases, this will be because you have provided your consent under this Privacy Policy.  

We may process your Personal Information:

  • to provide the services you have requested or have expressed an interest in;

  • to allow you to download of any content we make available;

  • send you newsletters and information relating to other services we provide;

  • respond to your communications and feedback; 

  • analyse and/or improve our services;

  • to invoice you and to collect money that is owed, including authorising and processing credit card transactions

  • to protect and/or enforce our legal rights and interests, including defending any claim; 

  • to comply with our legal obligations, including any notification and reporting obligations and any access directions imposed on us by an applicable government agency, law enforcement agency or regulatory authority; and

  • for other purposes for which you have provided your consent.

 

Where we rely on your consent to use your Personal Information, you may withdraw your consent to further use at any time by contacting us at the contact details below. 

We may anonymise and aggregate information such that no person could be re-identified from the information. This aggregated and anonymised data is not Personal Information and this privacy policy does not apply to it. 

 

Disclosing Personal Information

We may disclose your Personal Information to:

  • An emergency service and/or reputable mental health support provider where we reasonably believe that you may be at imminent risk of self-harm

  • The Institute of Executive Coaching and Leadership for the purpose of coaching supervision and maintenance of professional standards

  • Your employer, but only where you provide us with your further express permission to do so

  • Service providers and suppliers who provide necessary goods and/or services to us, such to process payments

  • A person who can require us to supply Personal Information (e.g. a Government agency, court, regulatory authority or law enforcement agency) or where we believe it is necessary to investigate, prevent or take action regarding illegal activities, and as otherwise required by law

  • Any business that supports us, including hosting or maintaining any underlying IT system or data centre that we use to provide our website

  • Other third parties to anonymise and aggregate statistical information

  • Any other person or entity authorised by you

 

We may share aggregate, anonymous, or de-identified demographic, statistical, and other information regarding use of our website and services with third parties for marketing, analytics, planning, and other purposes. Such information will not identify any specific individual.

 

We do not sell or rent or otherwise commercially exploit any Personal Information.

How We Protect Personal Information

We maintain appropriate organisational and technological safeguards to help protect against unauthorised use, access to or accidental loss, alteration or destruction of Personal Information. We also seek to ensure our service providers do the same.

How long we keep Personal Information

We will keep your Personal Information:

  • until we no longer have a valid reason for keeping it;

  • until you request us to stop using it; or

  • for as long as required by law.

 

Your Rights

In addition to knowing how your information is being collected, used and who it is shared with, you also have the right to:

  • request access to your Personal Information

  • stop receiving unwanted direct marketing

  • ask for Personal Information to be corrected if you think it is wrong

  • make a complaint if you think your Personal Information has been mishandled

 

If you are based in the EEA you have the right, under the GDPR, to:

  • in certain circumstances, have your Personal Information erased

  • restrict the processing of your Personal Information

  • move, copy or transfer your Personal Information easily for your own purposes across different services in a safe and secure way

  • object to processing where we rely on our legitimate interests as the lawful basis for processing

  • withdraw your consent at any time, where our processing of your Personal Information is based on consent

  • lodge a complaint with an appropriate supervisory authority, if you consider that our processing of your Personal Information has breached the GDPR.

We have no responsibility for or control over the information collected by any third-party website and we cannot be responsible for the security and privacy of any information you may provide when visiting such websites.

Changes to this Privacy Policy

We will update this Privacy Policy when necessary to reflect any changes to our services and practices. When we make changes, we will post the date at the top of this Privacy Policy so you know when those changes were made. Where a change is significant, we’ll make sure we let you know – usually by displaying a notice on our website. We encourage you to periodically review this Privacy Policy to be informed of how we are protecting your information.
